O status de bem móvel dos animais no Código Civil de 2002 e a necessidade de um novo tratamento jurídico: a concepção de família multiespécie e a tendência da "descoisificação" dos animais domésticos à luz da atual jurisprudência

This paper aims to discuss the legal nature of animals in Brazilian law, and how this definition is no longer compatible with the challenges that the judiciary has been facing. Influenced by anthropocentrism and speciesism, animals were considered inferior beings, excluded from law. With the discovery of sentience, ability to feel, and consequently to suffer, one's view of animals changed. Nowadays, domestic animals have the status of movable property, with constitutional protection against abuse, however the legislation is not in accordance with the concept that society gave to pets. Introduced into the multispecies family, these “kids” are sometimes a matter of dispute when the relationship is over, and these issues have already ended up in the judiciary, which without the legislation to support it, sought by family law, by analogy, the solution for the “guard”, “visitation” and “alimony” of these pets. Multispecies family.O presente trabalho tem por objetivo discorrer sobre a natureza jurídica dos animais no Direito brasileiro, e como essa definição não é mais compatível com as lides que o Poder Judiciário vem enfrentando. Influenciado pelo antropocentrismo, e o especismo, os animais foram considerados como seres inferiores, excluídos do direito. Com a descoberta da senciência, capacidade de sentir e consequentemente sofrer, a visão que se tinha dos animais mudou. Atualmente, os animais domésticos possuem o status de bem móvel, com proteção constitucional contra maus tratos, no entanto a legislação não está de acordo com o conceito que a sociedade deu aos pets. Introduzidos na família multiespécie, esses “filhos”, por vezes, são motivos de disputa, quando o relacionamento acaba, e essas questões já foram parar no Judiciário, que sem legislação em que se amparar, buscou no Direito de Família, por analogia, a solução para a “guarda”, “visitação” e “alimentos” desses animais de estimação.
